Lionel Fynn has been specialising in Town Planning matters for over 40 years. These have encompassed a wide range of subjects including personally conducting Town Planning Appeals, Enforcement Appeals, and dealing with legal proceedings taken on noise nuisance matters under the Environmental Protection Act 1990. Because of the increasing preponderance of noise related issues Lionel Fynn became an Associate Member of the Institute of Acoustics some 10 years ago. Noise related cases, be they linked to Town Planning or Noise Abatement Notices on the grounds of statutory nuisance have always involved Lionel working in association with fully qualified members of the Institute of Acoustics.
In this case Lionel was instructed to act for a Shooting School that specialised in clay pigeon shooting and which after a number of years of initial operation achieved permanent planning consent status in 2003. A simplistic noise condition was attached to the condition which, in its construction, did not follow the advice of the relevant Guidance. The result was the imposition of a condition that measurements from the acousticians working on the case had demonstrated would, on occasions, not be complied with. During the course of the talk Lionel will demonstrate how the correct technical approach in liaison with both the Planning Authority and adjoining residents was eventually adopted in the drafting of new planning conditions which resulted in planning consent that effectively brought about a new chapter in the planning history. Lionel is presenting the case to the Institute of Acoustics in the hope that members will find it helpful to see how the correct approach eventually solved the problem and how the Acoustic experts could have arrived at that result in 2003 by becoming closely involved the planning process.
