As the pressure for new housing grows, this workshop will examine the key paragraphs in the draft revised NPPF that relate to noise, including the altered structure and proposal to introduce ‘Agent of Change’ to policy, including reference to statutory nuisance and implications. S180 states “Planning policies and decisions should ensure that new development can be integrated effectively with existing businesses and community facilities (including places of worship, pubs, music venues and sports clubs). Existing businesses and facilities should not have unreasonable restrictions placed on them as a result of development permitted after they were established. Where an existing business or community facility has effects that could be deemed a statutory nuisance in the light of new development (including changes of use) in its vicinity, the applicant (or ‘agent of change’) should be required to secure suitable mitigation before the development has been completed.” The bones of the IOA response will be developed from this debate.
